How can you believe that photoshopping a dick into someone else profile picture was just for some fun and laughs, when the person you were insulting in the first place didn't think it was humorous? I think anyone would be extremely offended if you took a photograph of them, made it into something pornographic and made them the ass of your jokes. You knew what you were doing, you knew it was against the AUP, and I think you deserve the ban.

Just to clarify:
The month-and-a-half ban was only not a perma because Mikail forgot to make it one. It really should have been, as Micha3l then evaded a ban for posting hardcore Rule 34 several times. Shit happens. Mikail tells the other mods to give Micha3l the benefit of the doubt, as Mikail did not perma the ban.
This ban may, and, I think, should, be permanent, and is in place due to Micha3l shopping a dick into H's hand and then linking it in his profile.
Arguments for permaban:
He obviously knew there was rulebreaking afoot, as he went out of his way to /whisper it to anyone who wanted to see specifically because he knew he'd be banned for this if he posted it in open chat. He also should've been permabanned before this, but got lucky and the mod forgot to permaban it. I'm sure there's something to be said about taking another user's pictures and, without their consent, photoshopping a dick into it, as well.
Arguments against permaban, as far as I can tell:
It's nothing you wouldn't see in National Geographic. He wasn't warned about it, to his knowledge, and the picture link was not removed from his profile until he did so himself, instead being immediately banned. People thought it was funny, and the person depicted with a handful of dick didn't seem to care.
... man, I'm sure there's some viable argument for why he shouldn't be banned, but I'm just not seeing it. I'm gonna respond to each of the ones I do see here, in order.
National Geographic, for one, does have some things that would not be allowed by the AUP (such as nipples) - and they're not allowed because tK really doesn't need to get sued or anything if a minor sees it.
There is most definitely precedent for /banning somebody for something they had in their profile. Joeking, for example, got banned once for posting a picture of a hentai blowjob (with semen EVERYWHERE) and then eventually got permabanned for having links to poorly photoshopped porn in his profile. Other than that, there's actually some other definitions of pornography, one of which is, directly from Dictionary.com:

This one sealed the deal for me. I originally voted Absolutely in your favor, but after reading the thread I decided to withdraw my vote. I didn't flip sides and vote Absolutely Not because I would agree that a month+ long ban for a first time offense, with no warning, etc, is excessive. But... that clearly isn't what happened here. I feel your version of the story was deliberately misleading. |

On the contrary, I think that if I was holding like a hotdog or something and someone shooped a dick in there, it'd be pretty awesome. I think there are other people who would agree. To say that EVERYONE would be offended if something like that happened to them is unreasonable, as there are people who enjoy that kind of humour. Granted, not everyone does. This one time, some chick wrote a gay fanfiction about me and two other guys and I thought it was hilarious. |

I don't think the number of people that share your sense of humor matters much, if at all, unless that number of people is so overwhelming that it becomes self-evident that the AUP is: A) Outdated B) Not serving the users C) Trying to fight a battle it can never win / only win to the obvious detriment of TK itself. But that's a difficult argument to make in this case. To be frank, the majority of the western world would find your dick-humor kind of juvenile. Or are you saying that you don't expect people to put forth the effort to click open your profile. Then, remarkably, do the mundane task of clicking the mouse a second time to see your offensive picture...so it's alright that you broke the AUP rules...because people (Even the moderators and the girl who you're insulting in the photo) are either lazy or that they should just ignore links altogether. So it's now our fault if we click the link in the first place. |
